For the civil law notary, authenticating an instrument involves gathering together and expressing the wishes of those involved, completely, impartially and fully in accordance with law. The authentic instrument or notarial deed is the result of a complex process, during which the civil law notary will inform and advise clients on the legal, financial and tax consequences of their projects, and on the legal instruments that are best suited to achieving them, while rejecting any improper, unfair, illegal or immoral undertakings.

 

Civil law notaries and deputy civil law notaries are licensed legal professionals with a Masters Degree in law.
By appending their seal next to the signatures of the parties on the instruments they draw up, civil law notaries assume responsibility for their content and form. They have to make sure the authentication process has been fully respected;
 that the authenticated instrument respects the wishes of its signatories, their identity, their legal capacity,
and the date and content of their undertakings.

An authentic instrument or notarial deed has a value similar to that of a judgment and cannot be contested,
except by judicial means. Authentic instruments have evidentiary value, which applies to both the justice system
and the public administration, in addition to all third parties. Unlike private agreements, they are also enforceable,
enabling the contracting parties to obtain direct enforcement of their reciprocal obligations before the courts.
